Definition

The Utilities Contracts Regulations 2016 (UCR) govern public procurement by utilities operators in the water, energy, transport, and postal sectors. The regulations transposed EU Directive 2014/25 and apply to organisations operating in those sectors whether publicly or privately owned (because EU utilities procurement law is sectoral rather than ownership-based). Thresholds under UCR 2016 are higher than PCR 2015 to reflect typical utility contract scale. The Procurement Act 2023 absorbs utilities procurement into the unified regime from February 2025 with sector-specific carve-outs.

How it works in practice

UCR 2016 applies to entities meeting the utility definition: water companies, energy network operators, public transport providers (Network Rail, Transport for London, certain bus operators), postal services, and operators of specific waste sectors. The regulations are similar in structure to PCR 2015 but with utility-specific flexibilities: longer typical contract terms, simplified rules for certain framework arrangements, and adjusted exclusion grounds. Thresholds are higher: above-threshold goods/services around £429,000 and works around £5.3 million (figures revised periodically). Above-threshold notices publish on Find a Tender. Many utilities have established frameworks with detailed pre-qualification (Achilles UVDB is the major utilities supplier database, comparable to Constructionline for construction). UK utilities have material public procurement spend: Network Rail and Transport for London each procure £multi-billion annually; the water companies collectively procure £multi-billion in network and treatment infrastructure. Under PA 2023 utilities are largely absorbed into the unified regime with some carve-outs preserving sector-specific flexibilities. The 2016 Regulations continue to apply to pre-existing procurements through their term and to non-PA-2023 jurisdictions (Scotland operates a separate regime).
