Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the KimonBids platform and website operated by Kimon Services Ltd ("we", "us", "our"). By creating an account or using the platform you agree to these Terms. If you do not agree, do not use the platform.

2. The service

KimonBids provides a platform for discovering, scoring, and responding to UK public sector tender opportunities. The platform includes AI-powered matching, go/no-go recommendations, bid drafting tools, and related features as described on the pricing page.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will not be liable for any modification, suspension, or discontinuation of the service.

3. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.

One account per individual user. You may not share account credentials with others unless on a plan that expressly includes team access.

4. Subscriptions and payment

Paid subscriptions are billed monthly or annually as selected. Payment is due in advance. We use a third-party payment processor; by subscribing you agree to their terms as well as ours.

You may cancel at any time. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial periods except where required by law.

We reserve the right to change prices with 30 days notice. Continued use after a price change constitutes acceptance of the new price.

5. Free plan and trial

The free plan is provided without charge subject to the usage limits stated on the pricing page. Free plan AI bid drafts are watermarked and are not intended for direct submission. We may modify or discontinue the free plan at any time with reasonable notice.

Trial periods, where offered, provide full access to the stated plan features for the duration of the trial. At the end of the trial your account will downgrade to the free plan unless you provide payment details and subscribe.

6. Acceptable use

You agree not to:

• Use the platform for any unlawful purpose
• Attempt to gain unauthorised access to any part of the platform or its infrastructure
• Scrape, copy, or redistribute tender data in violation of the applicable government licences
• Use the AI bid drafting tools to produce content that is intentionally misleading or fraudulent
• Resell or sublicense access to the platform without our written consent
• Interfere with the operation of the platform or other users' access

7. Intellectual property

KimonBids and all its components, including software, design, and content, are owned by or licensed to Kimon Services Ltd. You may not copy, reproduce, or distribute any part of the platform without our written permission.

Content you create using the platform (bid responses, documents) remains your property. By uploading content to the platform you grant us a limited licence to process it for the purpose of providing the service.

8. AI-generated content

The platform uses AI to generate matching scores, recommendations, and bid content. This content is provided as a starting point to assist your bid writing process. You are responsible for reviewing, editing, and ensuring the accuracy of any content before submission. We make no warranty that AI-generated content will be accurate, complete, or suitable for any specific procurement.

9. Tender data

Tender data displayed on the platform is sourced from UK government portals under the Open Government Licence v3.0. We make reasonable efforts to keep this data accurate and current but cannot guarantee completeness or accuracy. Always verify tender details directly with the buying authority before submitting a bid.

10. Limitation of liability

To the maximum extent permitted by law, Kimon Services Ltd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of profits, loss of contracts, or loss of data.

Our total liability to you in any 12-month period shall not exceed the total amount you paid to us during that period, or £100 if you are on the free plan.

11. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
