About CPV 09
CPV 09 is the Common Procurement Vocabulary division covering petroleum products, fuel, electricity, and other sources of energy. It is the division under which the public sector buys the energy it consumes, rather than the equipment that consumes it.
The division covers electricity supply, natural gas supply, heating oil and solid fuels, vehicle fuels, renewable electricity and green tariffs, heat supply from district networks, and increasingly power purchase arrangements for renewable generation.
Energy is unusual among public procurements because most of it is not bought by the organisation that uses it. Aggregation is the norm: public bodies join buying arrangements operated by a small number of specialist organisations that purchase energy on behalf of hundreds of members, using flexible purchasing strategies that buy in tranches across a period rather than fixing a price on one day. That structure means the visible notice flow understates the market, because the large volumes are contracted centrally.

Top buyers procuring CPV 09
The visible buyer base is narrower than the actual one, because aggregation hides the members behind the buying organisation. In our own corpus the Ministry of Defence is the most frequent publisher under this code, alongside energy brokerage and consultancy organisations, the UK Atomic Energy Authority, The Crown Estate, and procurement consortia serving the housing sector.
The Crown Estate's presence reflects a distinctive part of this market: it manages the seabed leasing that underpins offshore wind, which generates procurement quite different from ordinary energy supply. Defence is a large direct buyer of fuel and of energy for a substantial estate. Councils and universities appear most often in the renewable generation stream rather than in supply.

The median notice sits around two million pounds, the highest of any division covered here, and the upper decile runs into the hundreds of millions. Energy is simply expensive, and contracts aggregate consumption across many sites and several years.
Suppliers should understand that price in this division is frequently not the competitive variable. Where energy is bought through flexible purchasing, the commodity cost passes through and the competition is on the service wrapper: the accuracy of billing, the quality of consumption data, the handling of meter changes, and the support for the buyer's net zero reporting. Bidding on unit rate alone misreads what is being evaluated in the large supply arrangements.
Compliance and certifications for CPV 09 bidders
Licensing is fundamental: electricity and gas suppliers require the relevant supply licence from the energy regulator, and buyers verify it. Fuel suppliers require appropriate carriage and storage compliance, including operator licensing for tanker fleets and compliance with storage regulations at depot.
Renewable generation procurements attract requirements around grid connection, planning consent, and the technical standards governing embedded generation. Power purchase agreements require demonstrable additionality and robust origin certification if the buyer is claiming carbon benefit, and buyers have become considerably more careful about the substantiation of green tariff claims following scrutiny of what such tariffs actually deliver. Suppliers should expect to evidence the source of renewable claims rather than assert them. Reporting capability is increasingly a scored requirement, since public bodies must report emissions and need consumption data at a granularity that older billing systems do not provide.

Can a supplier win public sector energy business without joining an aggregation?
For supply, rarely. The realistic route for a supplier is to compete for the aggregated arrangements themselves when they are recompeted, which happens infrequently and at very large scale. Smaller and specialist suppliers more often find opportunity in generation, storage, and heat rather than in supply.
What is a power purchase agreement and why are public bodies signing them?
It is a long-term contract to buy the output of a specific generator, often a solar or wind installation, at an agreed price. Public bodies use them for two reasons: price certainty over a long horizon, and a credible claim to genuinely additional renewable energy rather than a tariff backed by purchased certificates. They are complex to procure, involve long negotiation, and require the buyer to take a view on decades rather than years, so they are mostly used by larger organisations or consortia. For suppliers and developers they represent one of the more accessible routes into large public sector energy contracting.
How much scrutiny do green tariff claims attract now?
Considerably more than a few years ago. Buyers have become aware that a renewable tariff backed only by purchased certificates does not necessarily cause additional generation, and many now distinguish explicitly between that and contracted output from identified generators. Suppliers should expect to explain what backs the claim, and should not assume a certificate-backed tariff will satisfy a buyer with a robust net zero reporting position. This is one of the clearest examples in public procurement of an evaluation criterion tightening because buyers learned more about the product.
Is fuel supply a separate market from energy supply?
Effectively yes, and it is far more accessible. Vehicle fuel, heating oil, and solid fuel are bought locally or regionally by organisations running fleets, depots, and off-grid buildings, and are procured through ordinary term supply contracts where delivery reliability and local presence matter more than scale. A regional fuel distributor can compete for this work without any involvement in the aggregated electricity and gas market. Blue light services and councils with rural estates are the most consistent buyers.
